1. Field of application of the General Terms of Sale and contract conclusion

These general terms of sale apply to sales contracts concluded with private customers and companies via the website of the International Red Cross and Red Crescent Museum (www.redcrossmuseum.ch), hereafter “MICR”.

The terms of sale must be accepted each time an order is placed. Acceptance of these terms of sale certifies that the customer has understood said terms and accepts them unreservedly. These terms of sale may be amended at any time. The terms of sale in force on the date on which the order is validated together with any other special conditions stipulated with regard to the order (unit price, file format, etc.) shall apply.

The MICR will confirm the order. The contract is deemed to have been concluded as soon as the buyer has received confirmation including the invoice and has paid for the order.

When confirmation fails to reach the buyer within a reasonable time, the latter must take that to mean that the order has been rejected.

2. Payment

Our advance payment service accepts credit card payments only. The following cards are accepted: Mastercard, Visa, Postfinance, Maestro.

3. Validation

The general terms of sale are appended to the email containing the link to the payment site. By clicking on that link you confirm your acceptance of the general terms of sale in their entirety. Unless evidence is provided to the contrary, the data recorded by the MICR constitute evidence of all past transactions.

Once payment has been made, you will be able to print out a receipt containing your order number, which will be your basic reference and proof of payment.

4. Prices and special offers

Prices are indicated in Swiss francs (CHF). Value added tax (VAT) and advance recycling fees are included in the price. Handling and delivery charges are invoiced in addition.

The MICR reserves the right to change the prices at any time. The prices charged to the customer are those shown on the website when the order is placed.

5. Terms of delivery

The goods shall be delivered as quickly as possible.

6. Cancellation and withdrawal rights

In accordance with the EU Directive on distance contracts, private individuals may withdraw from a purchase agreement within seven days without giving any reason and without having to pay a penalty. This right may be exercised from the day on which the merchandise reaches the consumer. The customer may return the merchandise delivered at his own expense. The MICR will refund any advance payments in full.

If a customer withdraws from the contract because the merchandise is defective or for other reasons for which the MICR is accountable, the MICR must refund the amounts already paid and the cost of returning the merchandise.

7. Responsibility and guarantee

The MICR gives its assurance that the quality of the merchandise supplied is as stated, that it has no defects that could reduce its value or restrict its intended use and that it meets the functions and other specifications indicated.

The buyer is required to examine the merchandise immediately and to notify the MICR within 48 hours of receipt of any defects observed, solely by email: boutique@redcrossmuseum.ch

Beyond the 48-hour deadline, the merchandise is deemed to comply with all specifications and no claim or return is possible.

In case of defective merchandise, the buyer may choose either to withdraw from the contract and be given a refund or to ask for a replacement to be sent. The buyer nonetheless retains the right to claim compensation.

Should it prove difficult to provide a replacement, the MICR reserves the right to refuse to replace the item and to reimburse the buyer.

8. Secure payments and personal data

The payment platform is provided by our partner SIX Payment Services AG. It is protected by an effective security system. Transaction data are transmitted by means of a 128-bit SSL encryption process which is fully compliant with PCI DSS (Payment Card Industry Data Security Standard) rules.

Your personal information and data are required in order to enable us to process your booking and for our business relations. These data enable us to complete your transaction and to contact you if necessary.
The MICR undertakes not to divulge or to market any information whatsoever about you.

In accordance with Articles 8 and 9 of the Federal Act on Data Protection of 19 June 1992, we would like to point out that the data concerning you are used by our internal services and that you are entitled to access, correct and object to the personal data concerning you.

In order to access your personal data recorded by the IRCM, you simply need to send us a request by email or letter, quoting your family name, first name, address, email address and, if possible, your customer reference number:

9. Applicable law and place of jurisdiction

The sale of articles covered by these terms of sale is governed by Swiss law.

Any disputes will be dealt with by the regular courts of the Canton of Geneva, subject to the right of recourse to the Federal Tribunal.
